Read this first.

Chronic Trace is a wellness screening platform. It is not a medical device. It is not cleared, approved, or authorized by the U.S. Food and Drug Administration to diagnose, treat, mitigate, prevent, or cure any disease or condition. Any indicator the platform produces is a wellness signal intended to inform — never replace — evaluation by a qualified healthcare professional. Do not use Chronic Trace as the sole basis for any clinical decision.

1. Who can use Chronic Trace

You may use Chronic Trace if (a) you are at least 18 years of age, (b) you have been authorized by an administrator of your deployment to access the platform, and (c) you agree to these terms. If you are accessing the platform on behalf of an organization (a hospital, military unit, gym, school, research project), you represent that you have authority to bind that organization.

2. What Chronic Trace does, and does not, do

The platform does:

  • capture short involuntary-signal recordings using the device's standard camera, plus a tap-based reaction-time test;
  • extract numerical metrics across oculomotor, postural, autonomic, facial, and cognitive-motor (reaction time) domains;
  • fuse those metrics into wellness screening indicators presented to the operator;
  • support longitudinal trend analysis when repeat captures are performed.

The platform does not:

  • diagnose any disease or condition (including, without limitation, concussion, traumatic brain injury, stroke, or post-traumatic stress);
  • recommend, prescribe, or modify any treatment;
  • replace examination by a licensed physician, neurologist, or other qualified healthcare professional;
  • constitute medical advice in any jurisdiction.

3. Operator responsibilities

As an operator, you are responsible for: (a) obtaining appropriate consent from each subject before capturing screening data; (b) operating the platform within the scope of your professional licensure and your organization's policies; (c) interpreting screening indicators in the context of clinical examination, history, and judgment; (d) keeping your access credentials (password, PIN, invite link) confidential; and (e) notifying us promptly of any suspected unauthorized access.

4. Subject consent

Wellness screening with Chronic Trace requires consent. Adults (18+) may consent for themselves; minors require parent or legal guardian consent; service members may consent or have a commanding officer or unit medic sign on their behalf depending on operational context; subjects in occupational screening contexts may consent through their employer's authorized representative. The platform records the type of consent, who granted it, when it was granted, and the scope of activities authorized.

5. Acceptable use

You agree not to:

  • present Chronic Trace output as a medical diagnosis;
  • use the platform to make return-to-play, return-to-duty, or fitness-for-purpose decisions without independent qualified clinical assessment;
  • capture screening data from a subject without their (or their legal representative's) consent;
  • attempt to reverse-engineer, decompile, or extract source code from the platform;
  • circumvent rate limits, authentication, or other security controls;
  • use the platform in connection with any unlawful activity.

6. Intellectual property

Chronic Trace owns all intellectual property in the platform, including the d-CIIV multi-domain fusion methodology and related algorithms. Six U.S. provisional patent applications have been filed across the company's core technology. You receive a limited, non-exclusive, non-transferable license to use the platform for its intended wellness-screening purpose, subject to these terms.

7. Aggregated data

We may aggregate de-identified screening data — keyed by anonymous CT tag rather than by name — to support our regulatory pathway, to improve the platform's screening indicators, and to publish research. Where the subject is recorded as anonymous, no name or date of birth is included in aggregation outputs. Where the subject is non-anonymous, the operator and deployment have committed to obtaining consent that covers aggregated research use (this is one of the default consent scopes the platform captures).

8. International deployments

Chronic Trace is U.S.-based and classified EAR99 under U.S. Export Administration Regulations. We have conducted prototype evaluations internationally with medical and research partners. Operators using the platform outside the United States are responsible for compliance with applicable local law, including data-protection law (GDPR and equivalent regimes) and any local medical-device or wellness-product regulation.

9. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON- INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE PLATFORM'S SCREENING INDICATORS WILL BE ACCURATE FOR ANY PARTICULAR INDIVIDUAL OR THAT THE PLATFORM WILL DETECT ANY PARTICULAR CONDITION.

10. Limitation of liability

To the maximum extent permitted by law, Chronic Trace, Inc., its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the platform. Our aggregate liability for any direct damages shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim or (b) U.S. one hundred dollars (USD $100).

11. Indemnification

You agree to indemnify and hold harmless Chronic Trace from any third-party claim arising out of (a) your breach of these terms, (b) your misuse of the platform, or (c) your use of platform output as a basis for clinical decision-making in a manner that exceeds the wellness-screening scope described above.

12. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, for breach of these terms or for any other reason consistent with our published policies. You may terminate your account at any time from the Settings page.

13. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these terms or the platform shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

14. Changes

We may update these terms as the platform evolves and as the regulatory posture changes. Material changes will be announced in-app. Continued use of the platform after a change takes effect constitutes acceptance of the updated terms.
